STATEMENT: Trump Administration’s Request to 5th U.S. Circuit Court of Appeals Doubles Down on Cruelty in Health Care Debate

Washington, D.C. — Today, the U.S. Department of Justice informed the 5th U.S. Circuit Court of Appeals that it would not challenge a U.S. District Court ruling from December 2018 that invalidated the Affordable Care Act. Neera Tanden, president and CEO of the Center for American Progress Action Fund, released the following statement following the court filing:

Republicans in Congress suffered a historic defeat last November in an election that centered the future of health care in America. Rather than listening to the pleas of the American people, the Trump administration is doubling down on cruelty—seeking not only to end protections for people with pre-existing conditions but also to eliminate the entire health care law. If the Trump administration wants to spend the next two years in court fighting to take coverage away from roughly 20 million Americans* and putting insurance companies back in charge of Americans’ health care, we welcome a robust debate in the court of public opinion.
